Sales Tax: Wrong Answer

Every few years a presidential candidate, governor or other tax engineer has the vision that by increasing sales tax the government’s tax needs will be met.

They call it a fair tax or some other name for the replacement for income tax or property tax.

The issue is, according to the Bill of Rights, amendment 5, the last sentence states, ‘No private property can be taken for public use with out proper compensation.’

Retailers use their private property, money, labor, and equipment, to collect, process, calculate, and pay the sales tax to public government departments, for public use, with NO compensation. Plus with over 50% of the customers using credit cards, the retailers, are paying credit card fees to collect sales tax for public use with NO compensation.

It seems to me the collection of sales tax, for public use, with NO compensation for the retailers, creates an undo hardship on the retailers and is in violation of Amendment 5.

Increasing that hardship, with no compensation, seems unlawful, unfair and unjust. Either the compensation for collecting the sales tax should be increased to off set the cost of collection, or the hardship should be eliminated.

    I’m not sure if you are talking about Federal House Bill HR:25 The Fair Tax or not. If you are you
    need to read the 16th Amendment. HR:25 is the only tax related Bill before the U.S. Congress that calls for repeal of the 16th Amendment.

    “The Congress shall have power to lay and collect taxes on incomes, from whatever source derived,
    without apportion-ment among the several States, and without regard to any census or enumeration.”

    This Amendment must be repealed. It is the root of the Federal Governments power to use the current corrupt Federal Tax System. Before the 16th Amendment no direct taxes were allowed and all taxes had to be equal! Sales taxes are equal for every Citizen. They are visible for every Citizen to see at every purchase. There were no special loop holes for the well connected & privileged. The taxes could not be embedded in the cost of goods. HR:25 allows the Nation to transition back to the original language of the U.S. Constitution before it was corrupted by the 16th Amendment.
