Some of the terminology in the state law against the sale of beer and fuel by the same business may be up for debate.
The state of Pennsylvania currently bans the sale of alcohol in “locations, places and properties” that also sell liquid fuel and oil, meaning that convenience stores in Pennsylvania are currently not allowed to carry beer, but that rule now seems to be up for negotiation.
According to a report from Pittsburgh’s Action News, the Pennsylvania Supreme Court has decided to take a case where beer distributors will argue against the Liquor Control Board and the company that runs Sheetz stores. In the case, the two sides will argue the meaning of the words “location,” “place” and “property.”
The court justices will consider whether a convenience store can sell beer without violating the laws of the state.
Currently, there are approximately a dozen businesses that are allowed to sell beer, while also having gasoline pumps on the premises.
